Terms of service

In these terms, we, us, and our refer to Momilo Mio Food Ventures Inc., a Philippine corporation with its kitchen at 323 Majestic St., Cainta, Rizal. You and your refer to the person using the website or placing an order. Site means momilomio.com and any subdomain we operate. Order means a purchase you place through the site. Products means the pastries and related goods we offer for sale.

You may browse, read, and order from the site for personal or business purposes that comply with Philippine law and these terms. You agree not to copy or republish the site's design, photographs, or copy for your own commercial use without our written consent. You agree not to interfere with the site's normal operation, attempt to access areas you are not authorised to use, or use the site to send unsolicited messages.

At launch, we offer guest checkout only and do not require you to create an account. If we add accounts in a future release, you will be responsible for keeping your login credentials confidential and for any activity that takes place under your account. Notify us immediately if you suspect unauthorised access.

Listed prices are in Philippine pesos and include applicable taxes unless we say otherwise. We may correct pricing or product errors at any time and will let you know before charging you. An order is considered accepted when we send you a confirmation email; until then, we may decline an order, for example if a product is out of stock, the price was listed incorrectly, or we cannot deliver to your address. If we decline an order you have already paid for, we will refund the full amount to your original payment method.

We accept the payment methods listed on our FAQ page and on our checkout page. You are responsible for paying any charges your bank, e-wallet, or payment processor adds to the transaction. We do not store your full card details; card payments are handled by our payment processor PayMongo, which is regulated by the Bangko Sentral ng Pilipinas.

Delivery options, courier partners, zones, rates, and lead times are described on our shipping page. You are responsible for giving us a complete and accurate delivery address and for being available to receive the order. We use third-party couriers and are not responsible for delays, missed deliveries, or losses caused by the courier after dispatch, except where Philippine law requires otherwise.

No refund shall be issued once payment is confirmed. Orders are final and cannot be cancelled or changed for a refund after that point. This does not affect your rights under the Consumer Act of the Philippines: if your order arrives damaged, defective, or not what you ordered, contact us and we will make it right.

You are entitled to a refund or replacement if your order arrives damaged in transit (crushed, leaking, broken, or otherwise unfit to eat, through our fault or the courier's), if we ship a different product, variant, or quantity from what you ordered, or if a product labelled as free of a specific allergen turns out to contain it.

To request a refund, message us through our contact page within 24 hours of delivery with your order number, a short description of the issue, and clear photos of the product as it arrived, including any damaged packaging. We acknowledge every request within one business day and process confirmed refunds within seven business days, back to the original payment method you used. How long the funds take to appear depends on your bank or e-wallet provider.

If you or someone in your household has an adverse reaction after eating one of our products, seek medical attention right away if symptoms are serious, and call us at 0935 393 2213 during kitchen hours (Monday to Saturday, 8:00 AM to 6:00 PM). We process your refund immediately while we investigate the batch; you do not need to dispute the claim.

Nothing in these terms limits your statutory rights under the Consumer Act of the Philippines (Republic Act 7394) or other applicable Philippine consumer-protection law.

The Momilo Mio name, logo, packaging design, photography, recipes, copy, and the look and feel of this site are owned by Momilo Mio Food Ventures Inc. or used with permission. You may share product photos and our site links on personal social media with attribution. Any other use, including resale of our content, requires our written consent.

You agree not to use the site to break the law, harm or harass others, transmit malware, scrape data at scale, attempt to bypass security controls, impersonate another person, or misuse customer-facing forms. We may suspend or block access to the site if you violate this section, and we may report unlawful activity to the appropriate Philippine authorities.

To the maximum extent permitted by Philippine law, our total liability to you for any claim arising from your use of the site or any single order is limited to the amount you paid for that order. We do not limit or exclude liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot lawfully be limited under the Consumer Act of the Philippines (Republic Act 7394) or other applicable Philippine consumer-protection law.

These terms are governed by the laws of the Republic of the Philippines. Any dispute arising from these terms or from your use of the site will be filed exclusively in the proper Regional Trial Court in Quezon City, without prejudice to your right under Philippine consumer-protection law to file a complaint with the Department of Trade and Industry or another competent authority.

We may update these terms from time to time. When we do, we will change the effective date at the top of this page and post the new version. Your continued use of the site after the new version takes effect means you accept the updated terms. We recommend that you review this page periodically.
